Our Terms and Conditions
. Each time you participate in the MOTZA Club you confirm your agreement to be bound by and acknowledge any changes to the Agreement (including the Policies). You also undertake to familiarise yourself with and comply with the Policies relevant to your membership level in the Club and the Rewards provided under this Agreement. By accepting this Agreement you agree to be bound by it. We may amend the terms and conditions of this Agreement from time to time in accordance with any legislative changes. Amended terms will be posted on our Site. Except as stated in this Agreement, in a Policy, or as otherwise notified to you, all amended terms will automatically be effective immediately. Your continued membership in the MOTZA Club following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes. If you do not agree with such changes to this Agreement (or any of our Policies), you must terminate your membership with the Club. In this Agreement where the context permits a reference to "you" includes anyone acting on your behalf or with your express or implied authority. A reference to this Agreement includes the Policies, unless stated otherwise.
The Motza Club
Proconsult Pty Ltd, trading as Property and Finance Solutions operates the MOTZA Club “the Club”. The Club will release a maximum of 20,000 WADs, each WAD is valued at $250.00. These WADs are issued to members according to the membership level subscribed to. Members are in turn eligible for Rewards Points which may be redeemed for goods and services offered by the Club through partnered businesses. Any individual, business or legal entity may become a member in the MOTZA Club with a minimum entry membership level up to a maximum membership level of Premium Platinum. An entry level member will be issued 1 WAD and a Premium Platinum member will be issued with a maximum of 40 WADs.
Funds received will be actively used to promote our services to potential property investors. The Club will reward each WAD and its respective WAD Holder “Member” with a percentage (%) of the commission payment received by Proconsult for any property purchased by an investor through our services.
The more property investors purchase through our services the greater the Rewards Points Members receive per WAD. The more WADs a member has the greater the Rewards Points.
Members are encouraged to refer their family, friends and social networks to join the Club and to use our services. The Club will reward added Bonus Points on top of the Membership Rewards for direct referrals (see Referral System below) and further Rewards for investors that are Members that use our services ( see Investor Rewards below).
Club Membership Levels
- Entry Level - 1 WAD = $250 (Minimum)
- Qualified Level - 4 WADs = $1,000
- Silver Level - 8 WADs = $2,000
- Gold Level - 20 WADs = $5,000
- Platinum Level - 40 WADs = $10,000 (Maximum)
Membership numbers are limited as there is a cap of a total of 10,000 WADs available to Members. Once the cap has been reached, the Motza Club will not take on new members.
Participation in the MOTZA Rewards Program starts at a minimum 1 WAD at $250 and up to a maximum of 40 WADs at $250/WAD ( $10,000.)
1 WAD is rewarded points based on a predetermined percentage (%) of the commissions received by Proconsult per property investment purchased through the services we provide.
NB: Commission payments received by Proconsult will vary from developer to developer and is thus noted as a percentage for accuracy.
Rewards Points are issued to Members on a quarterly basis after final settlement of the property investment purchased through the services we provide and only once cleared funds have been received by Proconsult.
The MOTZA Club offers further incentives to earn Rewards Points through referrals of friends and family as follows:
- Refer a friend to the MOTZA Club who becomes a member and receive a thank you gift of a MOTZA T-Shirt (The T-Shirt is a great icebreaker for perking interest in the Rewards Program).
- Refer friends to the MOTZA Club who become members with a combined total of 10 WADs – you receive a WAD for free. Let us know first that this is your goal.
- For every Referral to Property and Finance Solutions who purchases an investment property, you get rewarded with 20,000 Points.
NB: Only Members are eligible for the referral system.
As a MOTZA Club member, purchasing an investment Property through our services entitles you to receive a Reward of 50,000 Points (conditions apply - see our terms and conditions
As a MOTZA Club member, if you purchase an investment Property through our services, you will receive a Reward of 50,000 Points at settlement of the property. These points may be redeemed the following services - solicitor fees, handover fees, depreciation schedules and some stamp duty costs.
NB: Only Qualified Members with a minimum of 4 WADs are eligible for the investor incentives. Members may increase their membership status from Entry Level to Qualified to reach eligibility. The WAD value, depending on the number of WADs required to reach eligibility may be redeemed from available Rewards Points.
Prohibited, Questionable and Infringing Conduct and Activities
You are solely responsible for your conduct and activities regarding recommendations and referrals to the Club and all personal information, images, photographs, profiles, on the Membership Site. Your use of the Club shall not be false, inaccurate or misleading.
Registering as a Trial Member of the MOTZA Club and setting up an Account is free. Trial Members are encouraged to become Members after 1 month. There is a yearly Administration Fee of $25 charged annually at the end of each yearly period set from the time of joining the Program. The Administration Fee will be deducted from any Rewards Points due or, if there are no Rewards Points due at the time of charge, this will be charged to your Credit Card.
Refunds and Chargebacks
Funds collected for Membership in the Club are nonrefundable after expiry of a five-day cooling off period. The Club is not responsible for issuing refunds to Members after expiry of the cooling off period. The Club is wholly responsible for meeting any obligation or Reward stated or implied. You understand and agree that any attempt to make any charge back or otherwise reclaim or obtain a refund of or a credit against any funds paid to the Club without first having submitted a written notice to the Club at the following email firstname.lastname@example.org
within the five-day cooling off period and obtained a written consent to refund shall entitle the Club to retain the funds and include you in the Club unless and/or until such time as the fees are repaid or a credit or refund is agreed with the Club and solely at the discretion of the Club management. If a refund is made your membership will be deactivated and all access to the Rewards Program will be cancelled. The Club agrees to be accountable and responsible for settling any disputes, refund requests and charge-backs from Members. Any refund will incur an administration fee of $15 and this fee will be deducted from the funds paid into the Club.
The communications between you and the Club use electronic means, whether you visit the Site or send us emails. For contractual purposes, you (a) consent to receive communications from Property and Finance Solutions in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that Property and Finance Solutions provides to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.
The Club does provide support to Members. Support may be accessed by emailing email@example.com.
You and we are independent contractors, and nothing in this Agreement creates a partnership, employment relationship or agency. There are no third-party beneficiaries of this Agreement. You may not assign this Agreement or your rights and obligations hereunder, in whole or in part, to any third party without our prior written consent, and any attempt by you to do so will be invalid. Should any part of this Agreement be held invalid or unenforceable, that portion will be construed consistent with applicable law and the remaining portions will remain in full force and effect. Our failure to enforce any provision of this Agreement will not be considered a waiver of the right to enforce such provision. Our rights under this Agreement will survive any termination of this Agreement. The Club will not be liable for any delay or failure to provide its services caused by a factor outside the Site's reasonable control (including but not limited to any act of God, war, breakdown of plant, industrial dispute, electricity failure, governmental or legal restraint).
. We need this to ensure tracking of Rewards and to ensure distribution of Rewards. Without limiting any provision of this Agreement, your Information must be kept up to date.
Tax & Legal Compliance
In addition to this Agreement, you must familiarise yourself with, and comply with the Policies, domestic laws (including common law), state legislation, ordinances and regulations regarding your membership in the MOTZA Club. Members in the Club should be aware that Rewards Points redeemed by the Members could be taxable income. It is the Members responsibility to comply with local tax laws.
These terms and conditions are governed in all respects by the laws of Australia and any action arising under them or in any way connected with the Program may be brought only in a court in Australia, subject to any law which is expressly inconsistent with this.
